Terms of Service

1. Acceptance of Terms

By accessing or using MadeInSG ("Platform", "we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform. These terms apply to all users including buyers, makers, and visitors.

2. About MadeInSG

MadeInSG is an online marketplace that connects buyers with Singapore-based makers, artisans, and creatives. We provide the platform and infrastructure but are not a party to transactions between buyers and makers. Makers are independent sellers responsible for their own products, services, and fulfilment.

3. User Accounts

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and up-to-date information when registering.
• You are responsible for all activities that occur under your account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Maker Responsibilities

Makers who list products, services, or workshops on MadeInSG agree to:

• Provide accurate descriptions, photos, and pricing for all listings.
• Fulfil orders in a timely manner and as described in the listing.
• Comply with all applicable Singapore laws and regulations including consumer protection and food safety laws where applicable.
• Not list counterfeit, prohibited, or illegal items.
• Respond to buyer enquiries in a reasonable timeframe.
• Handle refunds and disputes in good faith in accordance with MadeInSG's buyer protection policy.

5. Buyer Responsibilities

• Review listing details carefully before making a purchase.
• Make payments promptly and in full.
• Communicate respectfully with makers through our messaging system.
• Not attempt to conduct transactions outside of the MadeInSG platform to circumvent fees or protections.
• Provide accurate shipping information.

6. Prohibited Activities

You agree not to:

• Use the platform for any unlawful purpose or in violation of these terms.
• Post false, misleading, or fraudulent listings or reviews.
• Harass, threaten, or abuse other users.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Use automated tools (bots, scrapers) to access or collect data from the platform.
• Circumvent platform fees by transacting directly with buyers or makers you met through MadeInSG.

7. Payments & Fees

All transactions are processed in Singapore Dollars (SGD). MadeInSG charges a platform fee on each successful transaction. Fees are deducted before payouts are released to makers. Specific fee rates are communicated during maker onboarding and may be updated with reasonable notice. Payments are collected by MadeInSG on behalf of makers.

8. Refunds & Cancellations

Refund eligibility depends on the listing type and the individual maker's policy. As a general guideline:

• Products: Refunds may be requested within 7 days if items arrive damaged or significantly not as described.
• Services: Cancellation terms are set by the individual maker and stated in the listing.
• Workshops/Classes: Cancellations made more than 48 hours before the session may be eligible for a refund or credit, subject to the maker's policy.

MadeInSG reserves the right to mediate disputes and issue refunds at our discretion in cases of fraud or significant misrepresentation.

9. Intellectual Property

All content on the MadeInSG platform, including logos, design, and software, is owned by MadeInSG. Makers retain ownership of their original content (photos, descriptions, artwork) but grant MadeInSG a non-exclusive licence to display and promote their listings on the platform and in marketing materials.

10. Limitation of Liability

MadeInSG acts as a marketplace facilitator and is not liable for the quality, safety, legality, or delivery of items sold by makers. To the maximum extent permitted by law, MadeInSG's total liability to you shall not exceed the amount paid by you for the specific transaction giving rise to the claim.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Singapore. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or a prominent notice on the platform. Your continued use of MadeInSG after changes take effect constitutes your acceptance of the new terms.
